What is a Scottish Trust Deed What is a Scottish Trust Deed?
A Scottish Trust Deed (Protected Trust Deed ) is a Debt help solution that is backed by Scottish Government Legislation, whereby you can effectively write off up to 75% of your outstanding debt These are suitable for people with debt of £5000 or more.
Protected Trust Deed's are voluntary agreements which are available to residents of Scotland. These allow people with debt problems to solve their debt problems whilst keeping their home*. This is done by making an application for a Protected Trust Deed (for which you must have lived in Scotland for at least 6 months prior to the application). Protected Trust Deed's are overseen by accountants in bankruptcy and they are known as the trustee, to whom the debtor's estate is transferred to. This is for the creditors to be paid.
Of all the people who have entered into a trust deed, many have kept their home, however, if there is any equity in the house, this may be required to be released through either sale (in extreme cases only), mortgaging or remortgaging this is to realise the full size of the estate and the "pot" from which the creditors will get paid.
A Protected Trust deed will not reverse any action that has already commenced unless the trustee can negotiate the lifting of any bank or wage arrestment.
How to get your Trust Deed
In order to facilitate such an agreement with you creditors, you must be in Scottish residency. You do need to speak with an insolvency practitioner, who should explain what options are available to you, respective of your financial position. Your income and outgoing will be evaluated to ascertain what your disposable income is, which will be divided into equal proportions to pay your creditors.
Obligations of a Trust Deed
You do have certain obligations when entering into a trust deed. Typically these are like any other legally binding contract to pay off your debt. These terms include but not limited to:
1. Full cooperation with trustee
2. Pay agreed amount on time
3. Advise trustee of change in financial circumstances immediately
4. Not Enter any new financial agreements before discussing with trustee

If you gain through an inheritance or an unexpected windfall for instance, or if things take a turn for the worse through unemployment for example, you should get in touch with the trustee to arrange a new review of your financial situation so that a new level of contribution can be determined.
If you circumstances do change for the worse and you can't realistically afford to pay your agreed contribution, although the contribution payments may be reduced by your trustee, you may have to release the equity in your property.
If a trustee refuses to discharge you at the end of your trust deed it would be for failing to cooperate with the trustee but it might still be possible to appeal to the sheriff to get discharges, obviously it would go towards any appeal to the sheriff if you can support your appeal where you can show that you did cooperate.
*Your home will not be repossessed even if your debts where secured on your property once a Protected Trust Deed has been entered into, unless proceedings to repossess your home have already begun, in which case the trustee will try to negotiate these proceedings being halted in respect of the Trust Deed.
If you decide to go ahead and try to enter a trust deed after reading the above you will be appointed a trustee, who will try to have your trust deed protected. There will be a certain amount of paperwork to be signed.
